4 Tips to Help You Find a Reputable Mesothelioma Lawyer

Mesothelioma is a rare form of cancer that affects the sac lining the chest (the pleura), the lining around the heart (the pericardium), or the lining of the abdominal cavity (the peritoneum). Studies have shown that people, who suffer from the disease mesothelioma, were exposed to an abundance of asbestos at one time or another in their life. Unfortunately, many people become exposed to asbestos unknowingly, usually as part of a job. Because of this, someone who has mesothelioma is often entitled to compensation. There are many mesothelioma lawyers, but the following easy tips can make it easier to find a mesothelioma lawyer.

1. Research all you can concerning mesothelioma. The more you understand the disease affecting you or a loved one, the better you will be able to judge a lawyer’s expertise. A lawyer who understands many aspects about the disease is the ideal lawyer. If your lawyer understands your or your loved one’s symptoms, and complications stemming from the disease, he or she will be better able to defend you. Unfortunately, some lawyers do not “do their homework” in regards to medical cases. This often leads to losing cases. A reputable lawyer will certainly know the ins and outs of the disease, so be sure to ask as many questions as you can think of.

2. Use phone books and Internet search engines to find lawyers. This may seem simple, but some people don’t bother taking the time to look through many lawyers. Accepting the first lawyer that calls, or that one sees on TV is not a good idea. Searching in Google for the keyword “mesothelioma lawyer” will yield better results in the end than simply accepting whatever lawyer comes along. Giving yourself a variety of lawyers to consider will give you the best idea of who will be willing to work hardest for you, who is sincere, and who will most likely help you win your claim.

3. Read the fine print, and know your lawyer’s case history. Once you are nearing your decision and narrowing down potential candidates, take your research to a new level. It is always a good idea to find out about a lawyer’s case history. Additionally, it is advisable to know exactly what kind of deal the lawyer is seeking with you. Lawyers dealing with medical-related lawsuits usually do not get paid unless they win the settlement. Some lawyers request different percentages. Compare these requests and choose the lawyer that you would feel most comfortable with.

Unfortunately, some lawyers might try to take advantage of an unknowing client. In order to protect your interests, and make sure you acquire the top-notch lawyer you deserve, do background research on lawyers before signing up.

4. Finally, don’t be afraid to take advice. If a friend, or colleague suggests a lawyer, don’t hesitate to check it out. If a friend refers you, he or she obviously has your best interests at heart, and so the lawyer is probably well qualified to take on your case. There are many groups out there for mesothelioma patients. If you or a loved one is in one of these groups, don’t hesitate to ask for advice from others who have mesothelioma. Advice is often taken for granted, but it is one of the most valuable things a friend can give.

The Emotions

Divorce is a scary, lonely and misunderstood process for most people, particularly when there are children involved. The mutual friends enjoyed during the marriage may not be of help because those individuals may not want to "pick a side." A divorce will introduce you to an entirely new balancing act.

The Effect on Productivity at Work

You must be conscious of how the divorce process affects your ability to function on your job. There may be occasions when you will feel overwhelmed by a typical day's workload. On such occasions, you may wish to apportion work in terms of what you can handle.

You may at times find yourself uncharacteristically testy and acerbic to friends and colleagues, uncommunicative, depressed, and distracted. You should try to be alert to these personality and mood changes and work with a counselor to solve them. At times this may involve temporarily modifying project responsibilities or adjusting assignments until you achieve a level of equanimity. On still other days, you may not be able to cope with the workplace or home environment at all, no matter how light the workload. When this happens, it may be prudent to request a brief personal leave. If your behavior and interaction cannot be altered through temporary changes, you may need to seek professional counseling during this stressful period.

Keep in mind that while going through a divorce you will face numerous demands on your time: meetings with an attorney, accountant and counselor, possibly locating a new residence (and furnishing it) and establishing new lines of credit. Plan ahead where possible for these contingencies by asking your employer for projects that do not have a tight deadline. Flexible working arrangements, such as job-sharing, or the opportunity to compensate for lost time by working in the evening or on weekends, are other possibilities.

You should not let others treat you as an emotional cripple. You are probably already experiencing feelings of helplessness and an inability to control your life. By being overprotective and shielding you from the daily realities of the workplace or running interference with fellow employees or clients, the employer may only exacerbate those feelings. Work may be the only place you can achieve a sense of self-worth and personal strength during this difficult period.

The Process

Some people winding their way through the divorce process may experience fatalistic or, conversely, unreasonably hopeful feelings, and may rely on divorce process myths that further complicate the situation (for example, a belief that the system is entirely gender biased). Unfortunately, the legal process is not designed to address emotional issues for the participants. Although there are milestones, such as filing the initial documents, there are no true emotional releases. Even the finalizing of a divorce is a bittersweet experience and is likely to feel like a letdown. No one truly wins in a divorce because the estate is always divided and both individuals have fewer assets than prior to the divorce. Unfortunately, the legal process is often one of attrition. The time and expense of the legal process often dictates the results as one of the parties can no longer afford the resources or the time to continue to dispute issues.

The many difficult aspects of the legal process often cause frustration and result in increased anger and hurt. In combination with the plethora of negative emotions which led to the divorce in the first place, one facing a divorce may turn to revenge as a primary motivation and extend the divorce proceeding to hurt the other spouse. On the other hand, a spouse may prolong the divorce process in the hope that reconciliation might occur.

The Solutions

Mediation may be the best answer. If you and your spouse can still communicate and have some common ground, mediation may be the most economical, efficient, and effective way to resolve the issues in the divorce. The mediator must be well trained and be competent in the area of family law. You should consult with an attorney before and after the mediation to be properly advised on negotiation of the issues and on whether the final result is a comprehensive solution.

You may need guidance in selecting an attorney. Your union, company corporate attorney or human resource department may be a source of names. The attorney should be practicing primarily, if not exclusively, in the area of family law (the area has become too complicated to be effectively handled by the generalist). The attorney should have the most current research software and resources available within the office (Lexis and FinPlan Divorce Planner are good examples). Competence, comfort and convenience are three primary considerations in selecting the attorney. Evaluate whether the attorney has a plan which will properly allocate resources to achieve realistic and wise goals.

You should be cognizant of the importance of limiting conversation with the attorney to the nuts and bolts and not try to convince the lawyer that the soon to be ex-spouse is a less than admirable human being; that's for a counselor. It will also save time and resources for an already stretched budget. Also, one should not fear asking another attorney for a second opinion at any point in the process. It is no more improper than having a doctor provide a second opinion on a serious medical condition.

The divorce process is time consuming in even the simplest cases and will make demands upon your schedule. Because the courts and your attorney are probably working the same schedule as you are, it is probable that some absences and interruptions of work will be unavoidable. Court dates, especially, are not optional. Advise your employer immediately of any court dates, as those occasions may require an absence from work for at least one half day. When you provide documentation regarding income or other employment information, keep in mind that the courts have strict guidelines and time limits. Promptly providing the necessary information is essential.

Lastly, as an attorney, I remind my clients that the legal process of divorce is basically to divide assets, arrange custody, establish support, and address insurance and debts among other issues. It is not the last argument or the final revenge. While the attorney can assist a person going through the divorce process on the legal matters, emotional help is more appropriately available from close friends or professional counselors.

If you’ve been pulled over and accused of a drunk driving offense, or more commonly referred to as a DUI or DWI, then you probably have a lot of questions. You are probably scared, confused, and a little angry if you didn’t feel you deserved it.

Regardless of the circumstances surrounding your incident you need to take immediate action to protect yourself, your freedom, and most importantly your driver’s license. You should consult with an attorney who specializes in DUI defense immediately. If you cannot afford to retain an attorney then consider meeting with one during a free consultation to get as much free help as possible. Here are some things you should consider:

1. Contact DMV and request a hearing within the specified amount of time (usually between 7-10 days depending on the state) to try and save your drivers license.

2. The time limit is calculated from the issue date of the temporary driver license or order of revocation which is usually the day of your arrest.

3. If you are out of state, or hold an out of state license that state's DMV will still take action against your license.

4. This temporary driver license (paper one the cop gave you) is valid for only a few days from the issue date unless you request a DMV hearing. If your DMV hearing is requested the motor vehicles will "stay"" your suspension and your temporary license will be extended until the hearing is complete.

5. Don't get the DMV hearing and the court appearance confused. The outcome of one almost never affects the outcome of the other.

In the DMV hearing, the hearing officer will decide on certain issues like whether the police officer had a legal reason to stop you; whether the police officer had a legal reason to arrest you; and whether or not the blood, breath, or urine result/test is reliable enough to suspend your license. This type of hearing is considered administrative and not criminal so if you expect to be represented you will need your own lawyer.

SMALL LAW FIRM VS. LARGE LAW FIRM: The size of the law firm has absolutely nothing to do with how well that office will represent you and/or handle your case. A large law firm (10 or more names on their letterhead) will not impress an insurance adjuster into giving you a better settlement. On the contrary, adjuster’s who’ve been around, know that huge law offices have multi-million dollar clients with mind-boggling legal problems. Because of this those types of law firms often do not put the time (nor concern) into a several thousand dollar personal injury case that a small office would. The bottom line? You’ll receive more and better attention from a small law office. Many of the best personal injury lawyers operate within the confines of a law firm with only two, three or, at the very most, four associates.

BEWARE OF LAWYERS WHO REPRESENT “DEFENDANTS”:The practice of law has become incredibly specialized. Find a lawyer who has experience representing claimant’s(called “Plaintiffs” in legalese) in personal injury cases.(You’re a “Plaintiff”). Be careful not to be represented by someone who is primarily an attorney for “Defendants’. These lawyers way of thinking are usually too closely tied to the values, attitudes and mental outlook of their cold and calculating insurance company clients.More often than not they’ll not extend themselves nor battle as hard - - consciously or unconsciously - - to obtain top dollar for your claim.(To you four or five hundred dollars more is a lot of money.To them it’s a drop in the bucket)!

COMPARISON SHOP: Talk to friends, acquaintances and/or co-workers who may have been represented by a lawyer on their own personal injury claim. Personal Injury lawyers normally don’t charge for an initial consultation.But, before you meet with them, find out if they do.If the answer to that is “yes”, go somewhere else.

While chatting with the lawyer, getting to know him and (generally speaking) what your case is all about, you should find out:

(1) How long have they been in practice?(10 years - plus - that’s good. 6 to 8 years is just okay. 3 to 4 years is highly questionable. 2 years or less is totally unacceptable).

(2) Roughly what percentage of his practice involves personal injury cases? If it’s less than 75% say “goodbye”.

(3) Does he often represent corporations and/or insurance companies? If he does than forge it, excuse yourself and take a walk.He’s not a Plaintiff’s attorney (you’re a “Plaintiff”) he’s a Defendant’s attorney (the insurance company is a “Defendant”). He’s not for you!
PAYING THE LAWYER - THE WRITTEN FEE AGREEMENT”: After you’ve discussed the fact’s of your case you may be able to get some sense from the attorney how much he thinks your case is worth, and how difficult it may be to get the insurance company to pay that amount.(He probably won’t commit himself. He’ll do a song and dance that would put Madonna to shame). Once you’ve grappled with that ask him exactly how much he’s going to charge you for handling your case?

If you’re at fault for the accident and it’s only your damaged ego that demands legal action he’s going to charge you for every move he makes - - and there can be a ton of them - - at hundreds of dollars an hour.If you have a case in which the other driver is clearly at fault (and your damages are substantial) his heart will be pounding with glee and he’ll be salivating furiously to have you hire him. In that instance he’ll be quite willing to waive all potential charges.
Usually, in the majority of cases, it should be a straight “Contingency Fee” with no costs assessed to you. Once your financial deal has been agreed upon ask him to put that into writing, in his “Written Fee Agreement”.(If he balks at a Written Fee Agreement you should begin to hum that old tune “I’ll See Ya’ Later Alligator”, get up, thank him for his time, and exit that office)
